The Honorable Kathleen O’Malley discusses her perspectives on patent policy, efficiency and patent eligibility, as well as injunctions and SEPs.
Drawing on RPX's data and intelligence, Mr. Howard will begin by providing a broad view of recent trends in District Court and PTAB, touching on the main issues with potential to disrupt the current landscape. This overview will be followed by an in depth analysis on Judge Albright, examining how public perception aligns with the data and his ruling behavior. The session will close with updates on new legislative and policy developments in China, along with the latest litigation numbers there.
In an increasingly connected world, disputes over standard-essential patents (“SEPs”) are often litigated in multiple countries and courts with varying approaches to antitrust and competition claims. Our panel of leading antitrust and SEP experts will delve into recent key policy changes and cases in the United States, Europe, and Asia and explore their impact on future SEP licensing.
This discussion will lift the veil on litigation finance, taking a close look at its role in the patent monetization ecosystem as well as its effects on the dynamics of dispute resolution. We will explore common elements of deal structuring; incentives to reach quicker, mutually beneficial resolutions; and practical approaches to navigating litigation campaigns funded by third parties. Underwriters, brokers, and lenders each play a role in bringing these solutions to market. How does it work, and what insurance products are available for plaintiffs and defendants to manage their risk to identified contingent exposures?
