Will Chuang, EVP of Client Relations, will sit down virtually with the Honorable Alan D. Albright to discuss a multitude of highly relevant and interesting topics of the moment, including the rapidly increasing size of the patent docket in the Western District of Texas, Judge Albright’s implementation of guidance from the Federal Circuit, public access to patent proceedings in his court, the interplay between district court proceedings and the PTAB, practice tips for counsel, and more.
Recent trends, including the rise of the Western District of Texas, third-party litigation funding, changes in the SEP landscape, design patent litigation, international litigation, and the evolving relationship between IPRs and district court trials, threaten to disrupt the relatively stable equilibrium of the last few years. This presentation will begin with an update on all these trends and their impact, followed by a deep dive into litigation outcomes, showing how data can be used to gauge risk, plan strategy, and seize tactical advantage, using notable campaigns and top districts as reference points.
Recent and ongoing changes in the landscape at the PTAB have led to new and growing uncertainties for stakeholders in predicting outcomes and effects of PTAB proceedings. The ongoing changes have made it difficult to stay on top of the constantly evolving and multifaceted developments in order to develop best practices. New guidance and precedential decisions from the PTAB and its reviewing courts have significantly impacted what PTAB proceedings are instituted and what deference they receive from the courts. Additionally, the courts will soon decide whether the PTAB in its current form is constitutional at all. Our esteemed panel will reflect on all of these developments and offer insights as to whether and how the new administration may further shift the PTAB’s course in the near future.
